The law in New York, in plain English

Mobile sports betting launched statewide on January 8, 2022, under Section 1367-a of the Racing, Pari-Mutuel Wagering and Breeding Law, and the New York State Gaming Commission licenses the operators. Its list names nine: Bally Bet, BetMGM, Caesars, DraftKings, Fanatics, FanDuel, Resorts World Bet, Rush Street Interactive (BetRivers) and theScore Bet, though Resorts World Bet stopped taking wagers in June 2025. bet365 and Hard Rock Bet are not licensed for mobile in New York. Retail sportsbooks also operate at the state's commercial and tribal casinos, and the minimum age for all of it is 21.

New York is also the state pushing hardest against prediction markets. In July a federal judge in Manhattan, Analisa Torres, declined to stop the Gaming Commission from enforcing state gambling law against Kalshi, and Attorney General Letitia James has since sued Kalshi (July) and Polymarket US (September) as illegal gambling operations. Novig, a CFTC-designated exchange where you take a position at a price set by other traders, launched in New York on August 4 and sued the state the next day to head off enforcement; no ruling had come in that case, and the state had not moved against Novig, as of this review. Novig, Kalshi and Polymarket US were all open to New York users. A bill known as the ORACLE Act would bar most sports event contracts in the state, but it has not passed either chamber. This page will change if any of that does.
